None of the resolutions adopted in various country parliaments recognizing the “Armenian genocide” have been able to base these resolutions on a valid justification in terms of international law. Because there is no basis in international law to accept an event called “Armenian genocide”. As explained and emphasized many times in our previously published articles on the subject, the “International Convention on the Prevention and Punishment of the Crime of Genocide”[[1]], prepared by the United Nations, approved by the General Assembly resolution 260/A of December 9, 1948, and opened for signature, acceptance or accession by member states, and which entered into force on January 12, 1951, in accordance with Article 13 of the aforementioned convention, is the strongest international legal platform for Turkey regarding the Armenian genocide allegations. This Convention is in the nature of a UN Criminal Code, is binding on all member states, and since it has been incorporated into the domestic law of each country over time, it is no longer possible to amend or abolish it. Therefore, it is the most solid legal basis regarding the crime of “genocide”. This Convention was prepared to fill the legal gap that was felt during the Nuremberg trials of German officials who committed war crimes after World War II. In the aforementioned court, the guilty Germans; They were accused, tried, and punished for “crimes against humanity,” which include inhumane treatment, torture, mass killing, massacres, etc. The charge does not include the crime of “genocide.” This is because, prior to 1948, there was no such crime as “genocide” in international law or the national laws of countries, nor was there even a word for it in any language. The word “genocide,” which gives its name to this crime, was created by combining the Greek word “genome,” meaning race, and the Latin word “caneo,” with the suffix “cide,” meaning “killer,” at the suggestion of the Polish lawyer Rafael Lemkin. Faced with this solid legal reality, those who defend the Armenian genocide lie both domestically and internationally are now resorting to propaganda claiming that the Armenian Deportations of 1915 were a crime of genocide. Although there is no crime called “deportation” among the five (5) crimes of genocide defined in Article 2 of the International Convention on the Prevention and Punishment of the Crime of Genocide[[2]], they are attempting to accuse the Turkish State, the successor of the Ottoman Empire, and the Turks of being “genocidal” on the pretext that the deportation carried out by the Ottoman State in 1915 was a crime of genocide. Deportation in international law
1- Article 6 of the Statute of the International Military Tribunal annexed to the London Agreement of August 8, 1945, signed between the Allied countries for the trial of German war criminals after the Second World War;[[3]] provides for the punishment of crimes against peace (paragraph a), war crimes (paragraph b), and crimes against humanity (paragraph c). In this paragraph (c), deportation is listed among crimes against humanity:
The following acts, or any of them, are offences subject to the jurisdiction of the Court and arise from individual responsibility.
c) Crimes against humanity: Killing, extermination, enslavement, deportation or any other inhuman act, whether or not it constitutes a crime under domestic law, committed before or during a war, in connection with or following an offence within the jurisdiction of this Court, and persecutions against all civilian populations on political, racial or religious grounds.”
2- Although Article 49 of the Geneva Convention of August 12, 1949 (IV Convention)[[4]] prohibits the deportation of protected persons from occupied territories in its first paragraph, its second paragraph permits deportation under certain conditions in the event of compelling military reasons:
The forced migration or expulsion of individuals or groups, including protected persons, from occupied territories to the territories of other countries, whether occupied or not, by the Occupying Forces, is prohibited for any purpose whatsoever.
However, the Occupying Forces may undertake the partial or complete evacuation of a territory for the purpose of ensuring the safety of the population or for compelling military reasons. The transfer of protected persons outside the borders of the occupied territory, except in cases where it is impossible to avoid due to materially important reasons, cannot be included in such territorial evacuations. As soon as the threat or danger in the evacuated territories is eliminated, “The evacuated persons are resettled in their homes in that region.”
3- The deportation ban mentioned in points 1 and 2 above imposes restrictions and prohibitions related to warring states. In contrast, 12 A
Article 13, paragraph 3 of the Additional Protocol (Protocol II) on the Protection of Victims of Non-International Armed Conflicts, dated June 8, 1977, which was added to the Geneva Convention of August 1949, states:
3. Civilians, when not directly involved in hostilities, may benefit from the protection provided in this section.”
1- The displacement of the civilian population cannot be ordered for reasons related to the conflict, except for compelling military reasons or reasons related to the safety of civilians. If such a decision is to be made, all necessary measures must be taken to ensure that the civilian population has adequate housing, sanitation, health, security and nutritional needs.” [[5]]
thus, it permits the displacement of civilians who are not parties to the conflict from the conflict zone for compelling military reasons and for security reasons in non-international conflicts.
4- However, Article 7/d of the Rome Statute of the International Criminal Court (ICC), adopted on July 17, 1998,[[6]] also lists displacement among crimes against humanity:
For the purposes of this Statute, crimes against humanity mean the following acts which are part of widespread or systematic attacks against any civilian population and are committed deliberately:
d) displacement or forced transfer of population;
However, for displacement, which is listed among “crimes against humanity” in Article 7 of the ICC Statute, to be considered a crime, it is conditional on being “part of widespread or systematic attacks against any civilian population and being committed deliberately,” and no connection is made to the idea that displacement is a crime of genocide.
5- Paragraph 477 of the International Court of Justice (ICJ - The Hague) judgment in the case of Bosnia v. Serbia (International Court of Justice, Application of the Convention on the Prevention and Punishment of the Crime of Genocide (Croatia v. Serbia), 3 February 2015, Judgment) refers to the ICJ's 2007 decision in the case of Bosnia and Herzegovina v. Serbia/Montenegro. Paragraph 477 states: “Ethnic cleansing, even if proven, does not, by itself, constitute the act of killing (actus reus) of genocide. For ethnic cleansing to be considered a form of genocide under the Convention, it must overlap with or be a part of one of the categories of crimes described in Article II of the Convention. Neither the intention to ethnically homogenize a region for political reasons, nor the operations carried out in pursuit of that intention, are considered as such (dolus specialis) in genocide.” “...the expulsion or deportation of a community, even by force, does not necessarily mean the destruction of that community.” “...If, during these actions carried out with the specific intent (dolus specialis) to destroy the community rather than to remove it from the area, the community is deliberately and knowingly subjected to living conditions which are intended to cause its partial or total physical destruction, in violation of Article II(c) of the Convention (1948 Convention on the Prevention and Punishment of the Crime of Genocide), this does not mean that the actions which can be described as ethnic cleansing do not constitute the crime of genocide.” [[7]]
In other words, the International Court of Justice states that when forced displacement is carried out in a region with the aim of ethnic cleansing, if there is no specific intent (as such=dolus specialis) to destroy the displaced group in whole or in part, the deportation cannot be defined as genocide.
6- The Second Geneva Convention, entitled the Convention for the Improvement of Conditions of the Sick and Wounded in the Battlefield, dated July 6, 1906, which was in force in 1915 when the Armenians revolted during the First World War,[[8]] contains nothing about deportation.
7- All the international conventions on “genocide” and “deportation” that we have listed so far, and the conventions related to the Nuremberg Tribunal and the International Criminal Court, emerged after 1945. The international law on genocide formed by these conventions is further developed by the Vienna Convention on the Law of Treaties, dated May 23, 1969, which entered into force on January 27, 1980. According to Article 28 of the Law of Treaties, which states that “Treaties (bilateral or multilateral agreements between states - H. Dural) shall not be applied, unless otherwise provided, to acts which occurred before the entry into force of the Treaty or to situations which ended before the entry into force of the Treaty,” it is not possible to apply them retroactively. In conclusion;
In the face of the Armenian genocide claims, which are an imperialist lie, the 1948 Convention on the Prevention and Punishment of the Crime of Genocide is the most solid international legal platform for Türkiye and Turkish citizens.
As explained above...
As can be seen from various international conventions and court decisions, all claims that the “Deportation” constitutes a crime of genocide are, just like the so-called Armenian genocide claims, an imperialist LIE. ——————-

3- Yukarıdaki sayılan 1. ve 2. şıklarda belirtilen tehcir yasağı savaşan devletlerle ilgili kısıtlama ve yasaklamalar getirmektedir. Buna karşın 12 Ağustos 1949 tarihli Cenevre Konvansiyonu’na ek olarak düzenlenen 8 Haziran 1977 tarihli “Uluslararası olmayan Silahlı Çatışmaların Kurbanlarının Korunmasıyla ilgili Ek Protokol’ün (Protokol II) 13. Maddesinin 3. Fıkrasında;
“Madde 13. Sivil nüfusun korunması
d) tehcir veya nüfusun cebren nakli;
5- Uluslararası Adalet Divanının (UAD-Lahey) Bosna-Sırbistan kararının (International Court Of Justice, Application Of The Convention On The Prevention And Punishment Of The Crime Of Genocide (CroatiaV. Serbia), 3 February 2015, Judgment) 477. paragrafında, UAD’nın Bosna Hersek – Sırbistan/Karadağ davasında 2007 tarihinde verdiği karara atıf yapılmaktadır.
“... Eğer topluluğun bölgeden uzaklaştırılmasından ziyade imhasının hedeflendiği özel kasıtla (dolus specialis) yapılan bu hareketler sırasında, Sözleşmenin (1948 tarihli Soykırım Suçlarını Önleme ve Cezalandırma Sözleşmesi) II. Maddesinin (c) bendine aykırı olarak, bilerek ve isteyerek, topluluğun kısmen veya tamamen fiziksel tahribine yol açacağı düşünülen yaşam koşullarına muhatap bırakılması durumunda, etnik temizlik olarak tarif edilebilecek hareketlerin soykırım suçu oluşturmayacağı anlamına gelmez.” [[7]]
Bu sözleşmelerle oluşan uluslararası soykırım hukukunu, 27 Ocak 1980 tarihinde yürürlüğe giren, 23 Mayıs 1969 tarihli Viyana Anlaşmalar Hukuku Sözleşmesi’nin (Vienna Convention On The Law Of Treaties) 28.
Sonuç olarak;

=======================
